Nail In The Fence

2010-03-16 @ 14:45 in General

Found this on my journey around the electronic highways today - thought it very poignant for this day and age - sadly....

There once was a little boy who had a bad temper. His Father gave him a bag of nails and told him that every time he lost his temper, he must hammer a nail into the back of the fence.

nail in fence

The first day the boy had driven 37 nails into the fence. Over the next few weeks, as he learned to control his anger, the number of nails hammered daily gradually dwindled down.

He discovered it was easier to hold his temper than to drive those nails into the fence.

Finally the day came when the boy didn't lose his temper at all. He told his father about it; and the father suggested that the boy now pull out one nail for each day that he was able to hold his temper.

The days passed and the young boy was finally able to tell his father that all the nails were gone.

The father took his son by the hand and led him to the fence. He said, "You have done well, my son, but look at the holes in the fence. The fence will never be the same. When you say things in anger, they leave a scar just like this one. You can put a knife in a man and draw it out. It won't matter how many times you say I'm sorry, the wound is still there." A verbal wound is as bad as a physical one.

Trackbacks? Turned it off as only the spammers use it anyway so no need for it...  So really - it's just a waste of time on there behalf..

Still tis fun beating there spamming ass all the time - heh heh heh Bring It On guys...Failure of epicness is given...HA! Tongue outCool

IRMA vs Eircom - The 'True' Story

2009-04-05 @ 15:45 in Controversial Stuff

Recently, I.R.M.A, the Irish answer to the American association R.I.A.A challenged Irelands main I.S.P. through the Irish courts as to being responcible for what there users do [basically]. Eircom rose to the challege initially but then captulated at the 11th hour and said they would comply with what I.R.M.A. was requesting. Well actually it was 4 of the major music/media companies but IRMA were in their for good measure..

[quote]

In what has been billed as a world first, four music companies and internet server provider Eircom have agreed to work together to end illegal music downloading.

The settlement brought to an end an eight-day trial in which the music companies were suing Eircom as the country's largest internet service provider - over illegal downloading.

The four music companies have agreed to provide Eircom with the IP addresses of internet users detected illegally uploaded or downloading music.

Well that was what was reported by the mainstream media. It seems though that this is not actually the 'Whole Truth' of the matter. I was a bit incensed by this story  and set about to find out what Eircoms position was to be on the 'Ligitimate' use of these websites... heres a copy of the e-mail I sent. Ok I know, not the most eloquent of e-mails but it got the point across.

So my e-mail to Eircom [which took a lot longer than two working days to be answered btw!]

Dear ssir/madam

I have read quite a bit lately about certain implications that you
intend to block specific files sharing websites?

Whilst i agree that there is some use for distributing some [Dubiously
claimed] copyright material, there is also a major amount of 'Legally'
available software, namely 'Open Source' software and other 'Legal'
files on the same website.

I was wondering what your position is in regards to blocking my 'Legal
and Legitimate' right of access to this material? What right you have to
block my access to 'Legally Available and Legitimate' material, be it
software or works of art.

If you intend to pursue such a matter, then I would be left with little
alternative but to counter sue you and the 'Conglomerates' that you are
supporting for infringement of my 'Legal and Legitimate Right of Access'
and also for
'Infringemnt of My Civil Liberties', 'False Insinuation' that by using
any of those websites that I intend solely to obtain [Dubiously Claimed]
copyright material.

What then is Eircoms position in relation to the above? We know how you
stand on the [Dubiously Claimed] copyright issue but I was wondering
what stance or what measures you are going to take so as not to
interfere with a persons Legal and Legitimate rights

I would be very interested to find out [as would others].

yours

It is well to note here that I specifically told them I intended to publish there reply. This has already been done at one place I visit and i thought what better way to get this place up and running again than to post it here..

Anyway ... I digress - there reply and I must admit I was quite surprised actually. It indicates something totally different as to that reported by the main stream media services, I'll let you judge for yourselves

Eircoms reply

[quote]

Dear Mr. My Name removed

eircom has not agreed to block any Internet sites from being accessed by
end-users. As part of the settlement of the above proceedings, it was
agreed that eircom would not oppose an application by the Plaintiffs to
seek to have eircom block access to the Pirate Bay website. The Music
Industry will still have to establish, in the normal way that there is
an appropriate basis for the relief which they seek from the Court.
eircom is not supporting or consenting to the application. The
settlement makes no provision for any site other than the Pirate Bay
website.

It is important to note that:

* eircom will not monitor its customer's activities at any stage.
* eircom will not implement any form of monitoring equipment or
software on its network.
* eircom will not provide personal details or any information
relating to its customers to any third party, including the record
companies. No personal data will be transferred from eircom to the
record companies which would enable any customer of eircom to be
identified. eircom has agreed to keep confidential and will not
disclose any information concerning its customers to the record
companies and it will in particular observe in all respects the laws on
data protection.

With Thanks
Thomas Ryan
Head of eircom Customer Care

How very interesting. Especially the latter part of the e-mail I recieved which totally contradicts what was said in the media and that indicates that the media have deliberatly reported something that is not true. But before I go 'Accusing' first I'm going to draft another e-mail and see what the mainstream media have to say about Eircoms reply [or they can ask here via the comments {comments are moderated btw to stop spam}] .

So first - to find a list of all the mainstream media who reported on this and specifically who reported that the music industry and IRMA had won there case because if what Mr  Ryan is saying is eircoms position then they have won nothing and media reports to that end are incorrect.

I'm actually at odds as to what category to place this under? Controversial stuff or IT and Tech?? Its both really.. Anyway will keep this updated as I proceed. I may even try getting some recorded phone calls together if possible and other interviews if I can. If we're lucky we may get some of those on camera... Anyway which ever i'll update as I have more but the above does show a completly different view than that purported bythe media....

Stage6 - There was a serious offer to purchase

2008-03-07 @ 21:44 in Web Services

It seems that serious offers to purchase stage6 were made at the last hour. Wonder why they have been rejected?/ For a second rate service like Veoh? Hardly! One wonders just what is going on with Divx and with all the rumours things just don't look good for them. Especially with this news that a serious offer to purchase was made!
